If the two countries are signatories to the Hague Convention on the Civil Aspects of International Child Abduction then the local jurisdiction will hear the case under the treaty rules and relevant case law and determine the proper jurisdiction and/or whether removal of the child is improper. In San Diego, cases under the Hague treaty will often be held in San Diego County Family Court and filed by the San Diego  District Attorney. Generally issues of the child's best interest are not to be considered and the hearings purpose is to determine which country has jurisdiction and whether the child was wrongfully removed.
