Steps In A  San Diego Divorce

All cases are unique this is just a general description.

1. Petition for Dissolution of Marriage is filed and served on Respondent. 
2. Respondent generally has 30 days to respond.
3. Either party may file an Order to Show Cause, requesting that the Court make  an order regarding, child support, visitation, attorney fees, spousal support,  or other relief.
4. Parties may then engage in discovery including, but not limited to exchanging Preliminary Declarations of Disclosure (DOD)  and Income and Expense Declarations. (IE)
5.  After discovery is completed both sides should discuss the feasibility of settlement.
6. If settlement is reached a Marital Settlement Agreement (MSA) can be filed and a Judgment of Dissolution will be entered.
7. If the parties are unable to come to an agreement on the issues then the matter will be set for trial.
